FTC Settles With Express Scripts to Lower Insulin Prices

The settlement follows a September 2024 enforcement action targeting the industry’s largest prescription drug benefit managers. The agency alleged that Express Scripts and its competitors manipulated the market by prioritizing high-priced insulin versions over more affordable alternatives to secure larger rebates. Under the new terms, the company must cease favoring high-wholesale acquisition cost drugs within its standard formularies and provide covered access to TrumpRx.

Reforming Pharmacy Benefit Models

According to the FTC, the agreement requires Express Scripts to expand the availability of its rebate-free model to employers and health-plan sponsors. By stripping away complex pricing structures, the commission aims to ensure that patients pay the lowest available price at the pharmacy counter. Express Scripts stated that these measures will bolster its commitment to putting American patients first while reinforcing the administration's healthcare priorities.

Impact on the Healthcare Market

FTC Chairman Andrew Ferguson claimed the resolution will provide "meaningful financial relief" to patients dependent on life-sustaining medication. Beyond consumer savings, the settlement is expected to benefit community pharmacies that have historically faced financial pressure from PBM practices. The commission noted that the shift will generate new revenue streams for local providers while ending the market "squeeze" previously exerted by dominant industry players.
